Terms of Service
These Terms of Service (“Terms”) govern your access to and use of imanna.ai and the Anna website, web app, desktop app and editor plugins (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you agree on its behalf.
1. Acceptance of these Terms
By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
2. The Service & beta status
Anna is an AI worker that reads code, builds and ships software, wires integrations and, at your direction, connects to third-party platforms on your behalf. The Service is currently offered as a beta: features may change, be added or removed, and may occasionally be unavailable or contain errors. We may modify or discontinue any part of the Service at any time.
3. Eligibility & accounts
- You must be at least 18 years old, or the age of majority where you live, to use the Service.
- During the beta, registration may require an invite code. You are responsible for the accuracy of your account information.
- You are responsible for keeping your credentials and API token secure and for all activity under your account. Notify us at admin@imanna.ai of any unauthorized use.
4. Acceptable use
You agree not to use the Service to:
- break the law or infringe others’ rights (including intellectual-property, privacy and data-protection rights);
- build, distribute or promote malware, spam, phishing, or content that sexually exploits minors or facilitates human trafficking;
- attempt to gain unauthorized access to, disrupt, overload, reverse-engineer or circumvent the security or metering of the Service;
- resell or provide the Service to third parties except as expressly permitted; or
- violate the terms or policies of any third-party platform you connect through the Service.
You are solely responsible for the content you create and the campaigns, messages and actions you direct Anna to perform, and for their compliance with applicable laws and platform policies.
5. Your content & intellectual property
You own your content. The code, files and data you submit (“Your Content”), and the software output Anna produces for you, remain yours. You grant imanna a limited license to host, process and transmit Your Content solely to operate the Service and perform the tasks you request (including sending necessary content to our AI sub-processors).
Our IP. The Service itself — including Anna’s software, models integration, skills, brand and website — is owned by imanna and its licensors. These Terms grant you no rights in our IP except the right to use the Service as permitted here.
6. Third-party integrations & ad spend
The Service lets you connect third-party accounts (e.g. Google, Meta) so Anna can act on your behalf. Your use of those platforms is governed by their terms and policies, which you are responsible for following.
Anna never holds or charges your advertising funds.
When you manage paid advertising through Anna, you connect your own ad account and the platform (e.g. Google or Meta) bills you directly. Anna helps you create, budget, activate and pause campaigns at your instruction — but you authorize and own every spend decision, and you are responsible for all charges the platform applies to your account.
7. Billing, credits & tokens
Core use of the Service is free during the beta; you pay only for the AI usage (tokens) you consume, via prepaid credits. Credits are purchased through Stripe, are consumed as you use the Service, and are non-refundable except where required by law. Prices and packaging may change; we will show current pricing in the app before you buy. Taxes, if any, are your responsibility.
8. AI-generated output
Anna uses AI models and can make mistakes. Output — including code, text, campaigns and recommendations — may be inaccurate, incomplete or unsuitable for a given purpose. You are responsible for reviewing, testing and deciding whether to use any output before relying on it, deploying it or spending money based on it. Similar prompts may produce similar results for other users; we make no claim of exclusivity in generic output.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that output will meet your requirements.
10. Limitation of liability
To the maximum extent permitted by law, imanna and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, or goodwill, or for advertising spend or third-party platform charges, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the three months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless imanna from any claims, damages, liabilities and expenses (including reasonable legal fees) arising from your content, your use of the Service, your advertising and campaigns, or your violation of these Terms, applicable law or any third-party platform’s policies.
12. Termination
You may stop using the Service and delete your account at any time (see data deletion). We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or as needed to protect the Service or other users. Provisions that by their nature should survive termination (e.g. content ownership, disclaimers, liability limits, indemnity) will survive.
13. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-laws rules, and the courts of Brazil will have jurisdiction, unless mandatory consumer-protection law grants you a different forum. Nothing here removes protections you have under the mandatory law of your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
